Respect to the Gone Viral TV Community
Please be respectful of our viewers, partners, and other’s content and act responsibly when providing us permission to air your videos.
We Review Videos Flagged As Inappropriate
Don't Cross the Line
Please find below a few rules regarding videos and the ability to post them online and on television:
• Gone Viral TV is not for pornography or sexually explicit content. If this describes your video, even if it's a video of yourself, don't send the video to Gone Viral TV. Also, be advised that we work closely with law enforcement and we report child exploitation.
• Don't post videos showing bad stuff like animal abuse, drug abuse, or bomb making.
• Graphic or gratuitous violence is not allowed. If your video shows someone getting hurt, attacked, or humiliated, don't provide it.
• Gone Viral TV is not into shock videos. Don't provide gross-out videos of accidents, dead bodies and similar things.
• Respect copyright. Only provide videos that you made or that you are authorized to use. This means don't provide videos you didn't make, or use content in your videos that someone else owns the copyright to, such as music tracks, snippets of copyrighted programs, or videos made by other users, without necessary authorizations. Read our Copyright Section for more information.
• We don't permit hate speech (speech which attacks or demeans a group based on race or ethnic origin, religion, disability, gender, age, veteran status, and sexual orientation/gender identity).
• There is zero tolerance for predatory behavior, stalking, threats, harassment, invading privacy, or the revealing of other members' personal information. Anyone caught doing these things may be permanently banned from Gone Viral TV.
Gone Viral TV is for the Community
Remember that this is your community! Each and every contributor to Gone Viral TV make the television channels what they are!
• Have fun with the channels. There's a lot here to see, and lots of folks making amazing stuff—one of them might be you! Equipment's getting cheaper and easier to use all the time, so dive in and enjoy.
• Let folks know what you think. Feedback's part of the experience, and when done with respect, can be a great way to make friends, share stories, and make your time with Gone Viral TV richer. So contact the video providers and leave comments, rate videos, make your own responses to videos that affect you, enter contests of interest—there's a lot going on and a lot of ways to participate here.
When providing permission to Gone Viral TV for using your video, you are warranting that you have cleared all necessary rights to the video. Gone Viral TV respects the rights of copyright holders and publishers and requires all video providers to confirm they own the copyright or have permission from the copyright holder to provide content. We comply with copyright laws and promptly remove content when properly notified.
Does Gone Viral TV get permission to air videos?
Yes, Gone Viral TV gets permission from the video creators to publish their videos.
Can Gone Viral TV determine copyright ownership?
No. Gone Viral TV isn’t able to mediate rights ownership disputes. When we receive a complete takedown notice, we remove the content as the law requires. When we receive a valid counter notification we forward it to the person who requested the removal. After this, it’s up to the parties involved to resolve the issue in court.
Can I use a copy right-protected work without infringing?
In some circumstances, it is possible to use a copyright-protected work without infringing the owner’s copyright. For more about this, you may want to learn about fair use, see below.
Your video can still be claimed by a copyright owner, even if you have;
• Given credit to the copyright owner
• Noticed similar videos that appear on Gone Viral TV
• Purchased the content on iTunes, a CD, or DVD
• Recorded the content yourself from TV, a movie theater, or the radio
• Stated that “no copyright infringement is intended"
Some content creators choose to make their work available for reuse with certain requirements. For more about this, you may wish to learn about the Creative Commons license.
Fair use is a legal doctrine that says you can reuse copyright-protected material under certain circumstances without getting permission from the copyright owner.
Different countries have different rules about when it’s okay to use material without the copyright owner’s permission. For example, in the United States, works of commentary, criticism, research, teaching, or news reporting might be considered fair use. Some other countries have a similar idea called fair dealing that may work differently.
Courts analyze potential fair uses according to the facts of each specific case. You’ll probably want to get legal advice from an expert before providing videos that contain copyright-protected material.
In the United States, fair use is determined by a judge, who analyzes how each of the four factors of fair use applies to a specific case:
1. The purpose and character of the use, including whether such use is of commercial nature or is for non-profit educational purposes
Courts typically focus on whether the use is “transformative.” That is, whether it adds new expression or meaning to the original, or whether it merely copies from the original. Commercial uses are less likely to be considered fair, though it’s possible to monetize a video and still take advantage of the fair use defense.
2. The nature of the copyrighted work
Using material from primarily factual works is more likely to be fair than using purely fictional works.
3. The amount and substantiality of the portion used in relation to the copyrighted work as a whole
Borrowing small bits of material from an original work is more likely to be considered fair use than borrowing large portions. However, even a small taking may weigh against fair use in some situations if it constitutes the “heart” of the work.
4. The effect of the use upon the potential market for, or value of, the copyrighted work
Uses that harm the copyright owner’s ability to profit from his or her original work are less likely to be fair uses. Courts have sometimes made an exception under this factor in cases involving parodies.
